Terms of Service

1. Who We Are

Bersyn (“we”, “us”, “the Service”) is operated by Qualitas Imports ehf., kennitala 600416-0140, registered at Klyfjasel 3, 109 Reykjavík, Iceland.

2. What Bersyn Does

Bersyn scans how AI systems (such as ChatGPT, Claude, Perplexity, and Gemini) represent your product, diagnoses gaps in that representation, and generates corrective content you can publish. Scan results reflect AI-model output at the time of measurement and will vary between scans. We do not control the responses of third-party AI systems.

3. Your Account

You must provide a valid email address and create an account to use Bersyn. You are responsible for keeping your credentials secret and for all activity under your account. You must be at least 16 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service to generate misleading, fraudulent, or harmful content.
• Make identity claims about a product or company you are not authorized to represent.
• Connect sources (websites, repositories, documents) you do not have permission to access.
• Circumvent usage limits, billing controls, or rate limits.
• Reverse-engineer, decompile, or attempt to extract the Service's source code.
• Use the Service to violate any applicable law.

5. Your Content and Ownership

You retain full ownership of everything you submit to, and everything the Service generates for, your workspace — including product identity text, scan results, patches, and published material. We claim no intellectual-property rights over your content.

You grant us a limited licence to process that content solely to deliver and improve the Service, as described in our Privacy Policy.

6. Editorial Responsibility

Bersyn produces drafts, recommendations, and corrective content. Editorial responsibility remains with you. Review every Bersyn-generated artefact before you publish or distribute it. We do not guarantee accuracy, completeness, or suitability for any particular purpose.

7. Pricing, Billing and VAT

Paid plans are billed monthly at the price displayed at checkout. Prices are stated in US dollars and are exclusive of VAT. VAT is added at the rate applicable to your jurisdiction and collected by our payment processor (LemonSqueezy, acting as Merchant of Record) where required. An invoice is available for every charge from the billing area of your account.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; we do not prorate mid-period cancellations. Refunds are considered on a case-by-case basis.

8. Consumer Withdrawal Right (EU/EEA)

If you are a consumer resident in the EU/EEA, you have a 14-day right of withdrawal when purchasing a digital service. By starting to use Bersyn during that period you request immediate performance and agree that your withdrawal right will expire as soon as the Service is supplied to you, in accordance with Article 16(m) of Directive 2011/83/EU.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or events beyond our control. We publish planned downtime at /status.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or mandatory consumer-protection rights.

11. Termination

We may suspend or terminate your account if you breach these terms or engage in activity that harms the Service or its users. You may delete your account at any time from account settings or by contacting support.

12. Changes to These Terms

We may update these terms. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law and Jurisdiction

These terms are governed by the laws of Iceland. Any dispute arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the District Court of Reykjavík (Héraðsdómur Reykjavíkur), without prejudice to any mandatory consumer protection venue rights you may have in your country of residence.
